ANTI-CORRUPTION STANDARD FOR BEHAVIOR OF EMPLOYEES OF THE PRIVATE INSTITUTION “ZEREK COLLEGE”


  1. The anti-corruption standard of conduct for civil servants of the private institution College Zerek (hereinafter referred to as the Standard) was developed in accordance with Article 10 of the Law of the Republic of Kazakhstan of October 2, 2017 on Countering Corruption and is a system of recommendations aimed at preventing corruption in public relations arising from the implementation of information-analytical, organizational, legal and logistical support activities of employees.
  2. The standard is intended to form a sustainable anti-corruption behavior of the employees of the Collective Enterprise “College of Zerek”, to achieve an atmosphere of intolerance towards any manifestations of corruption, as well as to timely detect corruption and prevent their negative consequences.
  3. The principles of the Standard are:

1) legality;
2) transparency;
3) ethical;
4) respect for the rights and legitimate interests of individuals and legal entities and their protection against corruption;
5) avoidance of conflict of interest.

  1. Employees, in the exercise of official powers, are guided by the requirements of the legislation of the Republic of Kazakhstan.
  2. Employees within the framework of the current legislation of the Republic of Kazakhstan (including labor, anti-corruption, civil service):

5.1 5.1 in the exercise of the rights and legitimate interests of individuals and legal entities provide:

  • the priority of the rights and freedoms of citizens, the inadmissibility of manifestations of bureaucracy and red tape when considering appeals of citizens and organizations;
  • the minimum period for exercising rights and ensuring the legal interests of citizens;
  • the provision of public services in accordance with the standards and regulations of public services;
  • equal access to service recipients, without any discrimination for reasons of origin, social, official and financial status, gender, race, nationality, language, attitude to religion, belief, place of residence or for any other circumstances;

5.1.2. inadmissibility:

  • cases when consideration of a citizen’s application is imposed on a person in respect of whom there is reason to believe that he is not interested in an objective resolution of the issue;
  • appeal complaints to the detriment of the person who filed the complaint, or in whose interests it was filed;
  • referrals to officials whose actions are appealed in the appeal;
  • the possibility of disclosing, without the consent of citizens, information about their private life, personal and family secrets;
  • establishing the identity of the citizen, not related to treatment;
  • providing students with educational services, in the framework of the state general educational standard, on a fee basis;
  • collecting money from students and employees for cultural events (buying tickets, gifts, prizes, arranging premises), organizing meetings of commissions of various levels, repairs or other “needs” of a class, school.

5.2. in the preparation and adoption of management and other decisions within their competence provide:

  • a clear delimitation of competence and coordinated functioning of all structural divisions and officials;
  • the inadmissibility of issuing orders and instructions that are not related to the execution of official powers and (or) aimed at violation of the legislation of the Republic of Kazakhstan;
  • the inadmissibility of cases of selection and placement of personnel on the basis of kinship, fraternity and personal loyalty;
  • adherence to the principles of meritocracy;
  • personal responsibility for the legality of decisions.

5.3. in daily activities:

  • preserve and strengthen public confidence in the state and its institutions;
  • observe generally accepted moral and ethical standards;
  • ensure the maintenance of the authority of the government and the prevention of actions that could discredit the Republic of Kazakhstan, including opposition to corruption, strict observance of prohibitions and restrictions established by law for civil servants;
  • do not allow the commission of actions that can lead to the use of official authority and authority based on them in personal, group and other unofficial interests;
  • immediately inform management and (or) law enforcement agencies about cases of corruption offenses that have become known to them;
  • if necessary, bring to the attention of the head about the occurrence of a conflict of interest, personal interest in the performance of official duties, the inclination to corrupt behavior and the receipt of gifts;
  • refrain from addressing colleagues and managers with unjustified requests that violate the established order of relationships that may influence their adoption of an impartial official decision;
  • do not accept and do not give gifts in connection with the performance of official duties;
  • do not use official and other information that is not subject to dissemination in order to obtain or extract property and non-property benefits and advantages;
  • refuse to be appointed to the position if it is related to the direct subordination or controllability of persons who are in close family relations (parents, spouses, brothers, sisters, children);
  • they are active in countering corruption, in disclosing corruption offenses;
  • immediately inform the manager in writing about doubts about the legality of the order received for execution;
  • support the observance of a high legal and anti-corruption culture;
  • on an ongoing basis, take measures to eliminate the causes and conditions for the possible occurrence of a conflict of interest, corruption offenses and their consequences;
  • observe service discipline and work ethic;
  • do not allow in relation to the management manifestations of personal loyalty, desire to obtain benefits and advantages at the expense of their job opportunities;
  • for non-fulfillment or improper fulfillment of their official duties, they bear civil, disciplinary, administrative, criminal liability.
  1. Head:
  • their behavior serves as an example of impartiality, justice, unselfishness, respect for the honor and dignity of the individual;
  • carries out leadership through sole management activities and is personally responsible for the legality of decisions made;
  • does not require subordinate execution of orders that go beyond their official powers;
  • timely takes comprehensive measures to resolve conflicts of interest arising from a subordinate employee during the performance of his official duties;
  • takes comprehensive measures to prevent corruption and eliminate the causes and conditions conducive to the commission of corruption offenses;
  • refrains from participating in gambling with subordinates;
  • bears personal responsibility for the state of anti-corruption work among the employees subordinate to them and preventing them from committing corruption offenses.
